Parents facing weapons charge — attempting to protect daughter?

On behalf of Jack B. Rubin, PA posted in Weapons Crimes on Friday, December 20, 2013.

Parents, desperate to protect their children, may use extreme measures at times without considering the consequences. Four adults will appear in a court in Maryland soon to face a weapons charge as well as a charge of burglary. A young man was allegedly assaulted by the mother and stepfather of a young girl, as well as her father accompanied by his girlfriend.

After their daughter was arrested and accused of drug related crimes during October, the parents were reportedly determined to teach the girl’s boyfriend a lesson. They were portrayed as convinced that he was to blame for the girl’s drug problem. It is alleged that they unlawfully entered the house of the boyfriend and that the girl’s stepfather used a baseball bat made out of metal to beat him.

The victim’s sister arrived on the scene and contacted 911. She claimed to have seen the girl’s father carrying a hunting knife as well as a baseball bat, threatening to come back the following night. The victim was taken to a shock and trauma unit in Baltimore with a fractured skull.

None of these claims have been proved yet, and until they are, the four individuals remain innocent in the eyes of the law. All Maryland residents are guaranteed this right. Prosecutors will have the burden of proving the weapons charge and burglary accusation in court and according to the exacting standards of the criminal justice system. No individual defendant can be convicted unless the prosecution is able to prove beyond a reasonable doubt that they are guilty of the crimes charged.
